I am officially launching this page on democratique.ca to voice my total objection to the candidacy of Richard Deschamps for Interim Mayor of Montreal with reason that I will explain in a few brief moments. 

As we may all know, Mr. Richard Deschamps is one of six councilors in the LaSalle borough and a Union Montreal member, as well as Vice-President of the Montreal Executive Committee.

What some of us probably don’t know is that Mr. Deschamps is a strong voice of opposition to the notion of transparency and the many requests made to Mayor Manon Barbe by citizens, including myself, to allow recordings at the LaSalle borough council meetings during question period.

Only recently has Mr. Deschamps changed his tone on the subject of recording borough council meetings for reasons beyond my knowledge or perhaps due to the upcoming interim mayor election ?

Still to date, Mr Deschamps has no clear vision or solution toward this issue nonetheless.
 
Furthermore and Still to date, Mayor Manon Barbe of LaSalle has repeatedly rejected ALL REQUESTS stating firmly that it is a LaSalle borough regulation and also stated  "as long as her team is in power until November 2013, there will be no recording of council meetings in LaSalle. 

Recording LaSalle borough council meetings is clearly the transparent and democratic way to set the record straight and to equally watchdog our council meetings in order to establish accountability.

Mr. Deschamps’s lack of transparency is due to the simple fact that LaSalle citizens are currently faced with 7 on 7 Union Montreal representatives that offer no real cooperative solution towards facing this issue of transparency versus the reality of censorship in lasalle borough council meetings. 

The most disappointing results coming out of the Charbonneau commission revolve around UNION MONTREAL’s lack of transparency.  To add insult to injury, Montrealers are now confronted with yet another possible Union Montreal candidate Richard Deschamps to serve as their Interim Mayor in a final attempt to change 4 quarters for a loonie?


Mr. Richard Deschamps has clearly told some citizens including myself who approached him that if they don’t agree with the recording restriction by-law, then they should get elected and change it! 

GET ELECTED AND CHANGE IT !!!

WHAT DOES THAT EVEN MEAN TO A CITIZEN ???

 

In order to set the record straight I would like to expose this full audio copy which lasts no more than 60 seconds of the conversation which took place between myself and Mr Richard Descham  ps.On June 6, 2011, I attended, for the first time, the LaSalle Borough council meeting.

I approached Mr. Deschamps and introduced myself politely, which started a conversation regarding the democratic process in LaSalle council meetings,  While attempting to ask a question,
Mr. Deschamps clearly interrupts me and rudely tells me the following words:

 
"Sir, get elected and change it"


laughing profusely as he walks away.

How could Mr. Deschamps say this to a citizen the very first time he meets him ???

Does a citizen deserve to be treated in this most unprofessional manner by our elected officials ?

For this reason, It is imperative that our first conversation be exposed at this very moment via broadcast and the press to the citizens of Montreal. This must be done with the intention of voicing the whole truth about Mr Deschamps repeated opposition to the issue of transparency and dissenting voices of opposition.


What is Mr. Richard Deschamps hidden agenda ? 

Why does he shy away from transparency?


You be the judge !   After all, we are the citizens !

For the record, This recording  of our conversation is in full compliance with the one party consent laws depicted in the Criminal Code of Canada regarding the recording of one’s personal conversations. This recording does not infringe for the simple fact that the conversation took place following the adjournment of the council meeting, nullifying any by-law which governs the decorum of lasalle council meetings.


Now We all expect that the Mayor of Montreal’s role will now be to put democracy, transparency and the citizens’ concerns at the top of his or her political agenda once and for all.

My question is as follows:

Mr. Deschamps,  do you expect to practice clear democracy and transparency at this level in government, when you are known to be against dissenting and opposing voices in the LaSalle borough council meetings?

With all due respect, if you answer yes to this question, you must certainly have a Master’s Degree in Hypocrisy.  


Mr. Deschamps, with all this said, will you now step down the podium and reconsider your candidacy including a public apology to the people for the sake of being sincere to the citizens of Montreal and yourself. This all after the recording has now been exposed ?


What do you think about Mr Richard Deschamps attiitude towards the public on the subject of transparency and democracy ?

Extraordinary Montreal Council Meeting and Interim Mayor Election.

At this meeting November 16, I, Joseph Pugliese ATTEMPTED TO:  


Present this audio tape and democratique.ca during public question period to Mr Richard Deschamps in hopes that he apologizes to the public for his lack of respect towards the citizens and retracts his candidacy for Mayor.

The council was also voting for interim mayor where Mr. Richard Deschamps was a running candidate versus Mr. Michael Applebaum.
 
For the record, I was number fourteen (14) out of fifteen (15) registered citizens on the question period list. In order to get a turn at the microphone, you must first win a drawing . Upon arrival at the meeting, each citizen is given a ticket that will be drawn to determine who gets a chance to speak to the council.
 
Since the question period only lasts one hour, the council has the option to extend the period fifteen minutes providing there is a REASONABLE amount of citizens still waiting to be heard. In my case, we were only two citizens left giving no reason why the council would not allow the extention.


Was it due to the time surpassing the given hour, or is there more to it ? 


Would fifteen more minutes have really delayed the meeting when Richard Deschamps was given the time that citizens left out of question period were deprived of ?


Mr Deschamps capitalized on this time with a long and self righteous speech about how he works towards democracy and change, not to mention how open he is to opposition.

DID SOMEONE VISIT DEMOCRATIQUE.CA BEFORE MY TURN AND MAKE CERTAIN THIS PROOF IS NOT EXPOSED RIGHT BEFORE THE ELECTION ?

ERHAPS MR DESCHAMPS WAS PAINTING A VERY BROAD PICTURE OF HOW DEMOCRATIC HE IS WITH THE CITIZENS DURING THIS MEETING.

ALL THIS WHILE DEMOCRATIQUE.CA WAS WAITING TO EXPOSE THE TRUTH ABOUT HIS DEMOCRATIC WAYS TOWARDS THE CITIZENS OF LASALLE IN JUST MINUTES AWAY?

SÉCURITÉ FERROVIAIRE
TRAIN SAFETY IN LASALLE



Cette page a été construit dans les efforts de sensibilisation 
en ce qui concerne les déraillements possibles et les accidents évitables. 


Le pont ferroviaire est adjacent au pont Mercier situé sur le boulevard LaSalle, 
  à quelques pas de L'hôtel de ville LaSalle et de nombreuses maisons d'habitation. 

Ce n'est pas un secret que des nombreuses trains transportant des liquides non marquées passent à travers l'arrondissement de LaSalle sur une base régulière avec la cause majeure de 
préoccupation si un de ces trains devrait dérailler.

Ces trains passent au-dessus de l'eau et de la terre en mettant de nombreux habitants de 
LaSalle et d'autres communautés à risque en transportant des 

liquides / produits chimiques inconnus dans notre quartier.

Au cours de la séance du conseil d'arrondissement a LaSalle en Mai 2013,
 la mairesse Manon Barbe
 assure le public que dans le cas d'une telle catastrophe,
 LaSalle a 
un comité industriel en place qui travaille en collaboration 
avec nos services d'urgence locaux. 


La mairesse a également déclaré que la comité fonctionne des simulations de catastrophe 
régulièrement afin d'assurer une protection maximale pour les citoyens.
 

Actuellement, les quartiers résidentiels, comme LaSalle, y compris de nombreuses
 autres 
villes, villages, réserves et arrondissements, doivent aussi bien supporter
cette
 risque insensé à la charge de tout le monde! 



Au nom de tous les citoyens concernés de LaSalle je dis:

Arrêter ces trains de passer à travers notre arrondissement !
 



C'est le temps que nos élus TRAVAIL AVEC LES CITOYENS 
pour eviter tout accidents comme tel. 



Cette page est dédiée à la mémoire de toutes les victimes et les familles touchées par les 
événements tragiques de Lac-Mégantic, Québec, y compris de nombreux autres  
accidents ferroviaires insensées qui ont coûté un trop grand nombre de vies. 

Le samedi 6 Juillet 2013, aux environs de 01h20, la ville de Lac-Mégantic, 
Québec a été frappé par un train sans pilote rempli de pétrole brut. 

Ce train a parcouru librement sur une pente pendant 11 kilomètres avant de s'écraser
sur le centre-ville de cette petite communauté (population de 6000), suivi par
 le feu et
 explosions qui ont rasé le centre-ville et ont fait plus de 40 victimes. 

Au cours de la seance de conseil d'arrondissement a LaSalle en Mai 2013 , Joseph Pugliese 
de DEMOCRATIQUE.CA a soulevé l'inquiétude sur le plan d'action a LaSalle  
dans le cas qu'un train transportent des liquides deraille dans notre arrondissement. 



Cela à été dit moins de 2 mois avant la tragedie survenu à Lac-Mégantic, Québec. 


Pour cette raison, il est impératif que nos élus travaillent envers 
une solution permanente afin d'assurer que l'histoire ne se répète jamais.

LA TRAGÈDIE À LAC MÈGANTIC, QUÈBEC (CANADA)



 Samedi le 6 Juillet 2013 


Samedi le 6 Juillet 2013, à environ 01h30, la petite ville de Lac-Mégantic, Québec
(6000 habitants) a été le site d'un important déraillement de train.


Le déraillement a provoqué une série d'explosions catastrophiques suivie par des incendies
qui ont ravagé l'ensemble du centre-ville tout en revendiquant plus de 40 vies.



Le train qui a déraillé a été transportant du pétrole brut. 


 Au nom de DEMOCRATIQUE.CA, nous tenons à offrir nos plus sincères condoléances
à toutes les victimes, les amis, les collègues et les familles touchées par ces événements tragiques.



En ce moment, nous demandons que tous les citoyens de notre grand pays s'unissent dans la mémoire des victimes, des amis, des collègues, des familles et des citoyens de Lac-Mégantic, Québec dont leurs vies ont changé indefinitivement à cause de ces événements malheureux et évitables.

The letter DEMOCRATIQUE.CA deposited with the LaSalle borough Council Mayor Manon Barbe during the public question period requesting that the LaSalle borough permit DEMOCRATIQUE,CA to record our monthly borough council meetings in order to distribute the contents of these meetings to the public from this page on our site.

To date, DEMOCRATIQUE.CA is still waiting for a response from Mayor Barbe and the LaSalle borough legal department regarding this request.

Re: Full authorization for DEMOCRATIQUE.CA to begin exclusively AUDIO recording LaSalle borough council meetings effective January 2013.

Mayor Barbe,

As a concerned citizen and now registered local investigative journalist, I would like to take this moment to draft this request in hopes that audio recording our monthly LaSalle borough council meetings is permitted to DEMOCRATIQUE.CA (the media) as depicted in the 1993 CBC vs. NOVA SCOTIA case.

As you are already aware, DEMOCRATIQUE.CA was established in October 2011 with the intention of promoting participatory democracy in LaSalle.

Our website is in full operation presently and we are currently working on many other projects that will be presented to the general public in the near future.

Effective immediately, DEMOCRATIQUE.CA has been registered as a legal media entity and therefore falls under the jurisdiction of media regulations and “freedom of the press” in Quebec.

With respect to jurisprudence and our laws in Canada, I would like to once again deposit the 1993 judgment CBC vs. NOVA SCOTIA, (a copy in which I have already provided to you on two separate occasions). In this judgment, The Supreme Court of Canada ruled that all legitimate media outlets be permitted to record public meetings the intention of distributing its contents to the public, providing the procedure of recording does not disturb the decorum of the meetings (ex: bright lights, noise).

Effective January 2013, will the borough of LaSalle respect this Supreme Court judgment and allow DEMOCRATIQUE.CA the legal right to exclusively AUDIO record public meetings with the sole intention of

Distributing its contents to the public without disturbing the decorum of our monthly LaSalle borough council meetings? 

In accordance with the judgment, 1993 CBC vs. NOVA SCOTIA:

  • Will the borough of LaSalle equally accord DEMOCRATIQUE.CA the right to audio record all LaSalle borough council meetings with the sole intentions of distributing the un-modified original contents of each meeting to our website, DEMOCRATIQUE.CA for the public's opinion?

Mayor Barbe, in your October 25, 2011 comments at the Montreal City council meeting, you stated that LaSalle does not give preference to one media outlet from the next. With this said:

  • Will you equally accord Joseph Pugliese or any other journalist representing  DEMOCRATIQUE.CA the same rights to record our meetings as permitted for Le Messager LaSalle reporter Mr. Pierre Boulanger for his notes?

This fact that Mr. Pierre Boulanger is permitted to record our meetings has been confirmed to me in writing by the Trans-Continental Privacy Commissioner, the Privacy Commissioner of Quebec and by yourself in past council meetings.

As you have stated on many occasions regarding costs, DEMOCRATIQUE.CA understands that costs may be an issue to the LaSalle borough with regards to recording our council meetings. For this reason, DEMOCRATIQUE.CA would like to offer this service to the citizens of LaSalle and to the LaSalle borough council FREE OF CHARGE until November 30, 2013.

DEMOCRATIQUE.CA is passionate and committed to working with all the citizens and our elected officials equally as this pilot project is our way of giving back to LaSalle.

At DEMOCRATIQUE.CA, our goal is to promote participatory democracy in LaSalle without financial constraints.

This recording concept should equally help the LaSalle borough save costs that cannot otherwise be allocated for recording at the present time as you have stated Mayor Barbe.

Please be advised that effective January 2013, DEMOCRATIQUE.CA will equally be exercising our rights with respect to media functions and the procedures of the press to audio and video interview citizens (outside of the council room) attending these meetings.

With this said, I would like to take this moment to thank you for your consideration with regards to the regulations and procedures of media operations and “freedom of the press” in our borough council meetings.

I am looking forward to working with all the citizens and the borough council equally in the near future.

This article also reports the deposit Joseph Pugliese made with Mayor Manon Barbe requesting that the LaSalle borough council grant DEMOCRATIQUE.CA the right to record our council meetings as per the freedom of the press.

The December 3, 2012 LaSalle Borough Council Meeting.

In this segment, I will only be reporting the issue of transparency and the request made by DEMOCRATIQUE.CA to begin recording borough council meetings effective January 2013.

In the following months, DEMOCRATIQUE.CA will be interviewing citizens that attend these meetings and publishing both the citizens and the elected official’s version of the story. This will be performed in order to provide every aspect surrounding the facts and opinions regarding all the events at LaSalle borough council meetings, without prejudice.

DEMOCRATIQUE.CA is not financially motivated to turn the news in favor of the LaSalle borough council, or the citizens respectively. Rather, we pride ourselves towards covering the truth in its entirety without financial constraints or favoritism, whether it being towards paying clients, or anyone for that matter.

Can we say the same about certain media outlets out there mandate to cover our local news without borders? We will soon find out !

For the meantime, here is what DEMOCRATIQUE.CA has to say and why web diffusion and recording of our meetings will finally establish accountability within the ranks of our elected officials in LaSalle.

On Monday December 3, 2012, the LaSalle borough council meeting started off with the usual prayer and the public question period following shortly after. To start off this question period, Joseph Pugliese introduces his website DEMOCRATIQUE.CA as a new media outlet to LaSalle borough Mayor Manon Barbe.

Under “freedom of the press”, Mr. Pugliese deposits a written letter requesting that the LaSalle borough council permit DEMOCRATIQUE.CA to record the borough council meetings, effective January 2013.

Mr. Pugliese also requests that LaSalle borough Mayor Manon Barbe grant DEMOCRATIQUE.CA the same rights to record the meetings as already permitted for Le Messager LaSalle reporter, Mr. Pierre Boulanger.

At the present time, Mr. Boulanger is permitted to record the meetings and keeps these recordings for his own notes.

Mr. Pugliese states that effective January 2013, DEMOCRATIQUE.CA will be interviewing citizens attending these meetings (in the corridor and outside of the council room) as a part of a documentary he is filming with respect to LaSalle municipal government functions.

Mr. Pugliese then proceeds to deposit a jurisprudence regarding the 1993 CBC vs NOVA SCOTIA case in which the Supreme Court of Canada rules that all public meetings facilitate recording for the media. The Supreme Court also states that this must be done with the intention of distributing its contents to the public. Mr. Pugliese also reminds Mayor Barbe that this is in fact the third time he deposits this jurisprudence with her.

In response, Mayor Barbe directs DEMOCRATIQUE.CA’s media requests to the LaSalle borough court clerk in order for the borough to make a decision. Mr. Pugliese also suggests that Mayor Barbe think it over during the holiday season with an anticipated reply in early January 2013.

Mr Pugliese’s sub question is to Mr Richard Deschamps, LaSalle City Councillor. On June 6, 2011, Mr. Pugliese meets Mr. Deschamps for the first time where Mr. Deschamps clearly tells Mr Pugliese to “get elected and change it” for questioning the democratic process of LaSalle borough council meetings.

 Mr. Pugliese also asks Mr. Deschamps if he believes that his behavior in this recording is proof to LaSalle citizens why more transparency is needed in LaSalle by recording our meetings in order to establish accountability.

Mr. Pugliese equally asks Mr Deschamps why he considered running for interim Mayor last November 16 2012 if he cannot even treat the citizens of LaSalle with respect, not to mention his OBLIGATIONS TO TRANSPARENCY as the newly elected leader of UNION MONTREAL.

For his part, Mr Deschamps replies that it is perfectly normal for an elected official to rudely suggest that a taxpaying citizen form a political platform if they are not happy with the results at city hall (Mr. Deschamps reply to what he said the first time Mr. Pugliese attends a council meeting as per the recording)

 Mr Pugliese then replies, “So I guess if a LaSalle citizen is looking for change, you need to get elected to get it”

With the final question, Mr. Pugliese ask Mayor Barbe if she approves of these types of answers including Mr Deschamps disrespectful behavior towards the citizens (the man now heading the political party she is working for),


Unfortunately, Mayor Manon Barbe of UNION MONTREAL agrees with her new boss.



Mayor Barbe also goes on to tell the citizen Mr. Pugliese that  this is not a political debate forum and therefore the citizen should not play politics. Mr. Pugliese replies “ I am an investigative journalist, not a politician, I am here to cover a story !”

 

DEMOCRATIQUE.CA is waiting for a response from Mayor Barbe regarding permission to record these meetings effective January 2013.


Now with democracy and transparency in mind, will this story show up in LaSalle’s local newspaper “Le Messager LaSalle” fully un-censored and exactly or in and around the way I explained the facts ?

Will this be done by our local media in the name of telling the whole truth as I have done in this article ?

After all, I was present at the meeting including Mr Pierre Boulanger of Le Messager LaSalle covering the story who was present during my whole intervention.

My article was written to voice the citizens' side of the story straight about LaSalle borough council meetings.  The story is about the dedicated people who attend LaSalle borough council meetings with dissenting voices or opinions. The same citizens who, in our local newspaper, are brandished as a potential risk for daring to ask questions and demand answers?

At this meeting I asked Mayor Manon Barbe to publicly apologize for referring to the Vercheres tragedy and using it to the advantage of politics in her borough's newspaper articles 'Blasphemes, insultes et expulsion policiere' and "Periode de question, la mairesse serre le vis".

My sub question was addressed to Mr Marvin Rothrand of UNION MONTREAL whereby I asked Mr Rotrand to apologize for referring to me as an abusive citizen during the December 20, 2011 Montreal council meeting.

This article was published in the LaSalle Messenger by Mr. Pierre Boulanger,   The article reports that Mayor Barbe issued to me me a formal warning during the public question period. The formal warning was verbally issued following my attempt to speak while the Mayor repeatedly and rudely cut me off in an almost calculated attempt to get a reaction, which she didn't..

As the Newspaper article reports, I did deliver my message, but I received a formal warning as a result!.  After all, had I been out of decorum, the LaSalle Messenger would have reported it.

Montreal City Council Meeting, Public Question Period:

At this council meeting, I once again asked Mayor Manon Barbe of LaSalle to lift the restriction on recording in LaSalle and deposited the following documents with the council for Mayor Barbe’s consideration. The documents are as follows.

A Little More Transparency Is Needed

The open letter written by Mr. Edward Charters and was published in the LaSalle Messenger on December 15,2012. In this letter, Mr. Charters equally asks the LaSalle borough council to be more open on transparent in our municipal government functions.

Jurisprudence, 1993 CBC Versus NOVA SCOTIA (Speaker of The Assembly)

This judgement was handed down by the Supreme Court of Canada in 1993. In this landmark case, The Supreme Court ordered the NOVA SCOTIA (Speaker of the assembly) to facilitate the recording of their public meetings for CBC (New Brunswick Broadcasting Corporation) in the best interest of re-distributing its contents to the public. This judgement is also found in Le Manuel De L'elu Municipale, 5ieme Edition

In this Judgement, the Court also states that recording of these public meetings are permitted for the media providing the recording does not disturb the decorum of the meeting  (ex; bright lights, loud noise).

Once again, even with all this said, STILL the whole to no avail as Mayor Manon Barbe continues to resist the recording of our meetings, regardless of a Supreme Court of Canada ruling.

My Question was addressed to Mayor Francois Croteau of the Rosemont borough as follows:

Mayor Croteau with the fact that rosemont web diffuses their monthly borough council meetings, to date, has there been any complaints with regards to web diffusing your council meetings.

Montreal City Council Public Question period,

At this meeting, I once again asked LaSalle Mayor Manon Barbe to lift the recording restriction banning the recording of LaSalle borough council meetings.

Mayor Barbe refused to reply and requested that Marvin Rotrand reply on her behalf.      

My sub question was addressed to Mayor Gerald Tremblay whereby I asked him to assume his position as leader of our city and act on the illegal restriction imposed in LaSalle with respect to the recording of LaSalle borough council meetings.

Mayor Tremblay also refused to reply and also requested that Marvin Rotrand reply on his behalf.

The borough council was very resistant to recording our meetings for many years.

Our elected officials now agree that it's time for LaSalle to welcome a new era of transparency,

accountability and participatory democracy.

 

We are hopeful that this will remain the case in LaSalle borough council meetings,

and for many years to follow.

 

We would like to take this moment to cordially thank LaSalle borough mayor Manon Barbe and all our elected officials representing the

LaSalle Borough Council for taking a leadership role in this case and listening to the citizen's concerns.

 

This is a huge leap towards full transparency and censorship free politics in our borough.

We look forward to many great years of democracy, accountability, and honest politics in our beautiful borough of LaSalle.
